1. All sales are final.
  2. Warranty does not include any shipping costs, either to or from the Customers.
  3. Warranty claims require;
    1. A Return Authorization Number ( RAN ) issued by Apexmoto Inc, prior to shipping the faulty Product back to Apexmoto Inc. Contact sales@apexmoto.jp for a RAN, stating your name, address, product purchased, fault description ( picture’s where possible ) and date and means of purchase; and
    2. The return of the Product for fault verification in its original packaging.
  4. Refunds can only be issued;
    1. After faulty Product has been returned to Apexmoto Inc and where the fault is not caused by misuse, abuse, incorrect installation, incorrect application or accident. The Customer is responsible for all shipping costs.
  5. Returns must be packed in original packaging, ( as we have to return to the manufacturer ).
  6. Installation mistake or damage caused by accidents, mistakes or poor care during installation are not claimable.
  7. Refunds can only be issued where the good are received back at Apexmoto Inc., in the original packaging and in
    saleable condition ( no damage to packaging or the items ). Such returns must be shipped within 7 days of being
    received by the customer. The shipping records will determine the received date, so if a customer is out of town
    or away on holidays, the received date will be deemed the date the item was delivered to the customer address.
  8. Exchanges: Exchanges of Products can only be accepted where the original item has been returned to Apexmoto Inc at the Customers costs, and where the Product has some defect that was not caused by the customer, during installation or by accident.
  9. All products, unless otherwise specified, are warranted against defects or failure ( under normal use ) for a period
    of 12 months. Faulty or failed products will be replaced, excluding all shipping costs, within the limits specified in this document.
  10. Limitation of Liability: Liability on all products is limited to the purchase price excluding shipping costs, tax or duties.
  11. Governing Law: Product sold on Apexmoto.jp are governed and and construed in accordance with the laws of Japan.
  12. Cancelling an Order by Apexmoto Inc: We may cancel any part or full order without any liability to you for cancellation at any time if;
    1. The ordered products are not available; or
    2. There is an error in the pricing, description, price, dimensions, shipping costs or quantity in stock; or
    3. The order has been placed in breach of these terms and conditions.
  13. Cancelling an Order by Customer: Orders can be cancelled without cancellation fees where;
    1. For items on backorder, where we can cancel the order with our supplier without penalty; or
    2. For items that are in stock, that the item has not shipped from Apexmoto Inc, or our drop shippers.
    3. Under all other conditions cancellation fees apply as follows;
      1. Where the item has shipped, but has not yet been received by the Customer;
        1. The cancellation fee will be the to the total cost of shipping ( initial shipping and return shipping )
          at the rate charged by the shipper ( not return shipping is often more expensive than outgoing
          shipping due to volume rates applied by shippers ).
        2. The cost of any damage found to have occurred to the product during shipping.
  14. Cancelling an Order by Customer with Fees: For the following circumstances cancellation fees will apply;
    1. Where the item has shipped, but has not yet been received by the Customer;
      1. The cancellation fee will be the to the total cost of shipping ( initial shipping and return shipping )
        at the rate charged by the shipper ( note return shipping is often more expensive than outgoing
        shipping due to volume rates applied by shippers ).
      2. The cost of any damage found to have occurred to the product during shipping, not covered by
        the shipper.
    2. Where the item has been received by the customer;
      1. A restocking fee of 25% of the cost of items will apply plus all shipping costs incurred in the return of the items, provided the item is arrived unopened and undamaged condition.
      2. A restocking fee of 50% of the cost of the items will apply where the items packaging or the items themselves have been damaged, but are still in useable condition.
      3. A restocking fee of 100% of the cost of the items will apply, where the items or packaging are damaged beyond use.
